Cass County court records are documents and other materials generated, received, or maintained by a court, clerk of court, or court agency concerning a specific case handled by the Cass County court system. Additionally, court administrative documents that pertain to the management of the judicial arm of government and are not associated with any specific court case are also referred to as court records under Indiana Rules of Court Rule 3.

Are Court Records Public in Cass County?

Yes. Indiana Access to Public Records Act (APRA), I.C. § 5-14-3 to 5-14-3-10, grants members of the general public the right to inspect and copy records of public agencies, like courthouses. As a result, anyone can query Cass County courts to access court records.

However, the APRA's provisions are not absolute. Specific types of court records are exempt from the APRA's provisions under various state and federal statutes, rendering the exempt record inaccessible to the general public. Nonetheless, these exempt records may still be accessible to eligible persons, like the subject of the record, or pursuant to a court order. For instance, per Indiana Rules of Court Rule 5, the following are exempt from public access:

  • Records declared confidential by a state or federal statute
  • Sealed records
  • Records that pertain to a pending criminal case
  • Records of mental health cases filed under I.C. § 12- 26
  • Records containing information about pre-trial release and supervision and problem-solving court supervision
  • Medical records created or complied under Trial Rule 35.

Cass County Criminal and Civil Records

The Cass County Clerk is the official custodian of all court records in the county, including those from cases heard by the county Circuit Court and Superior Courts. These courts are responsible for handling most civil and criminal cases. Civil cases usually involve disputes between two or more parties, while criminal cases concern the government charging an alleged offender with a crime.

Interested persons can access public court records maintained by the Cass County Clerk online through the Indiana MyCase.in.gov portal. On the portal, users can search for court records by case number, a case party's (person or business) name, or an involved attorney's name or bar number. Additionally, on the portal, users can select Cass County under "Court" and Criminal & Citation and Civil under the "Limit search to" options to streamline their search.

Alternatively, record seekers can visit the Cass County Clerk's office to request or access court records in person. The clerk's office may have public access terminals that visitors can use to access case public criminal and civil records electronically onsite. Interested persons can also request and obtain physical copies of court records from the clerk's office for a fee. The County Clerk's Office is located at the Cass County Government Building.

It is worth noting that Cass County's criminal records are not limited to criminal case records alone. Records of law enforcement agencies, such as Cass County arrest records, are also considered part of Cass Criminal Records. The primary custodians of these records are local law enforcement agencies like the Cass County Sheriff's Office and municipal police departments. Hence, individuals can query these agencies to access Cass's arrest records.

Cass County Marriage Records

The Cass County Clerk preserves Cass County marriage records. These records are part of Cass County public records. As a result, they are available to the general public for inspection and copying.

Records seekers can use the Indiana Marriage License Public Lookup portal to search for public information about marriage licenses issued in Indiana, including Cass County, between 1993 and the present. The portal is accessible for free, and the names of the marriage license applicants can be used as search criteria. Researchers can also supply the marriage year (range) to narrow their search.

Cass County Divorce Records

Queries can be made in person at the County Clerk's office during regular office hours (8:00 am - 4:00 pm), Monday to Friday. Users can search for records on the portal by case details, party names, or attorney details. To specifically search for Cass County divorce records, users must select "Cass County" under the "court" option and select "family" under the "limit search to" option on the portal.

Cass County Birth Records

The Cass County Health Department and the Indiana Department of Health (IDOH) maintain Cass County's vital records, including birth and death records. Therefore, interested persons can order Cass County birth records through these agencies. The IDOH began recording birth records in 1907, while the Cass County Health Department holds older records.

Only individuals with a direct interest in the record can order certified copies of a Cass County birth certificate. These individuals include but are not limited to the person listed on record, their parent, grandparent, sibling (18 years or older), child or grandchild (18 years or older), and current spouse. Additionally, requesters must meet the identification requirement to order a Cass County birth certificate. According to the IDOH Fee Schedule, the birth certificate costs $10.00 and $4.00 for additional copies in the same order.

The Cass County Health Department offers walk-in services for ordering birth certificates. The Department's hours of operation are usually between 7:00 am to 4:00 pm, Monday to Thursday, and it is located at:

On the other hand, the IDOH accepts mail-in and phone orders for birth certificates. For mail-in orders, individuals can use State Form 49607. Requesters must complete State From 49607 and mail it along with applicable fees (via Check or money order payable to the Indiana State Department of Health), a copy of their required ID, and other required documentation to:

Cass County Death Records

The process for ordering Cass County death records is similar to that of birth records. Record seekers can order death records from the Cass County Health Department and the Indiana Department of Health (IDOH). The IDOH's death recordings began in 1900. Meanwhile, all deaths that occurred in Cass County are recorded with the Cass County Health Department.

Note that, like birth certificates, only certain persons with a direct interest in the record can obtain certified copies of a death certificate. These include but are not limited to the decedent's parent, grandparent, sibling (18 years or older), child or grandchild (18 years or older), and current spouse. Furthermore, requesters must present an acceptable form of identification and pay the required fees to order death records. For instance, the IDOH charges $8.00 for a death certificate and $4.00 for additional copies in the same order.

Record seekers can order death certificates from the Cass County Health Department in person at the Department's address. On the other hand, interested persons can order death certificates from the IDOH by mail using State Form 49606. The form must be appropriately completed and mailed with a copy of the requester's acceptable ID and required fee (Check or money order payable to the Indiana State Department of Health) to the IDOH. Alternatively, requests can be made over the phone by calling the IDOH toll-free number (866) 601-0891.

Cass County Probate Court Records

The Cass County Clerk preserves Cass County probate court records. Hence, interested persons can query the County Clerk's office to request probate court records. Queries can be made in person by visiting the County Clerk's Office, which is situated in the Cass County Government Building, during the office's hours of operation (8:00 am - 4:00 pm), Monday to Friday.

Interested persons can also search for and access Cass County Probate Court records online through the Indiana MyCase.in.gov portal. Users can perform a probate court record search through portal using case details, litigant's name, or attorney details as the search criteria. Cass County Property Records

Cass County Recorder's Office and Treasurer's Office maintain most property records in the county.
