Fortunately, there is no fee for filing for arrest record expungement under IC 35-38-9. However, there are certain waiting periods before an expungement petition for an arrest record may be filed, depending on the circumstances surrounding the arrest. For instance, arrests that resulted in dismissed charges are subject to a one (1) year waiting period. Once the relevant waiting period has been exhausted and the expungement petition has been prepared, it should be filed with either Huntington County Circuit Court or Superior Court. Subsequently, the court will notify the petitioner of a hearing or their petition's approval. If the latter is the case, the court will issue an expungement order and inform relevant government agencies.
