What Are Indiana Specialty Courts?

The Indiana court system has several specialty courts created to provide outcomes that are beneficial to the court’s participants and their families, the victims of the crimes committed by the participants, and the society at large. These courts are referred to as Problem Solving Courts. Indiana Problem-Solving Courts are mostly non-punitive courts that are tailored to deal with the needs of offenders, particularly those with drug abuse problems and mental illnesses. Problem-Solving Courts generally share some common elements, which are:

  • Focusing on outcomes—These courts seek to provide positive case outcomes for both the offenders and the victims of the offense by reducing recidivism and creating safer communities.
  • Judicial Involvement—Problem-Solving Court supervising judges take a more hands-on approach to address the underlying problems of the court’s participants and positively changing these participants behaviors
  • System Change—Problem-Solving Courts actively promote reforms in the government’s response to mental illness and drug-related problems
  • Collaboration—These courts work with external parties where necessary to achieve some of its goals
  • Screening, Assessment, and Earlier Identification of Potential Participants—Problem-Solving Courts utilize many screening tools to identify appropriate participants for the court’s programs and also to determine their eligibility
  • Non-traditional Roles—The roles and processes followed by the Indiana Problem-Solving Courts are not usually the same as those taken on in the state’s other courts. An example of this is the court’s mostly non-punitive approach to criminal justice processing.

Problem-Solving Courts offer a number of programs, such as:

  • Adult and Juvenile Drug Courts
  • Family Recovery Courts
  • Mental Health Courts
  • Reentry Courts
  • Veterans Courts

Problem-Solving Courts typically have a supervising judge for each state’s judicial circuits and a program director for each type of program available in the circuit.

Also, the Problem-Solving Courts have an overseeing committee. The Problem Solving Courts Committee was created to encourage judges to take a more proactive role in using non-adversarial, coordinated strategies for problem-solving. Equally, The committee encourages the broad integration of the problem-solving philosophy into the Indiana judicial system’s administration of justice while still preserving the rule of law.
