How Does the Indiana Superior Court Work?
Indiana Superior Courts are trial courts that exercise general jurisdiction over criminal and civil matters heard in the state. Even though Superior Courts have general jurisdiction over all criminal and civil cases, the specific jurisdiction of these courts varies from county to county. In addition to this, Superior courts can also hear appeals from decisions reached by Indiana City and Town Courts. Some cases typically heard in Indiana Superior Courts are:
- Felony and misdemeanor cases
- Juvenile, mental health, and probate cases (These courts share jurisdiction with the Circuit Courts over these types of matters)
- Civil cases, including general civil claims (In Marion County, small claims cases are heard by the county’s small claims courts)
- Certain domestic relations cases
The Indiana court system has more than 200 Superior Court judges. In most counties, judges are elected in partisan elections. These judges serve six-year terms and may run for re-election as many times as possible until 75. Judges in the state of Indiana are statutorily required to retire at this age.
The following counties do not elect Superior Court judges in partisan elections:
- Lake County and St. Joseph County - In these counties, interested applicants are selected by the county’s local nominating commission, and the state governor amongst the nominees appoints a judge. After the expiration of the first six-year term, judges who wish to remain in office must run in a retention election.
- Vanderburgh County and Allen County - In these counties, Superior Court judges are elected in non-partisan elections. However, in Allen County, when there is a vacancy, three potential replacements are nominated by the Allen County Judicial Nominating Commission, and one of these nominees is then appointed by the state governor.
Generally, Superior Court judges must be licensed law practitioners residing in the county where the Superior Court is located. However, some counties may have additional requirements.
There is no fixed time limit for cases heard in Superior Courts. However, when a Superior Court judge issues a decision, it can be appealed to the Indiana Court of Appeals. Typically, parties that wish to appeal must initiate the process within a 30-day period beginning from when the sentence was issued. Appeals from criminal cases involving capital punishment or a sentence of life imprisonment without the possibility of parole are sent directly to the Indiana Supreme Court.
Interested parties that wish to access Indiana Superior Court case records may do so online by utilizing the Indiana court system’s case search website. This website allows members of the public search for court records by name, attorney, or case number.
Alternatively, copies of Indiana Superior Court records can also be obtained in person at the Superior Court Clerk’s office, where the case was filed and heard. Requesters may be required to pay a nominal fee before copies of court records can be obtained via this method.
