Vigo County Arrest Records Vs. Criminal Records

Criminal records, also known as Record of Arrests and Prosecutions (RAP sheets), are a compilation of information related to a person’s history of arrests and prosecutions. The information contained in a criminal record is not determined by the result of the prosecution. Arrests will still show up on a RAP sheet even if they don’t lead to convictions.

Unlike criminal records, arrest records don’t present evidence that a person broke the law; they only indicate that there was suspicion of a crime and an arrest took place as a result. On the other hand, a criminal record will include any interaction a person has with law enforcement.

How Long Do Arrests Stay on Your Record?

In Indiana, information related to your arrest will stay on your record indefinitely and will remain accessible to the general public. However, if you are eligible, your arrest record can be expunged. In Indiana, this means your record will no longer be accessible to the general public but can still be accessed by those with the correct authorization, mainly courts and law enforcement agencies. In the absence of expungement, an arrest will remain on your record.

Expunge Vigo County Arrest Records

Arrest records can have detrimental consequences, such as making basic activities like job searches and house hunting difficult. Fortunately, it is possible to remove an arrest from your public record. This is a process known as expungement. Expungement involves the restriction of a public record, typically a criminal or arrest record, from public access. In some cases, expunged records are completely destroyed and made inaccessible to the general public, courts, and law enforcement agencies.

In Indiana, expungement closely resembles sealing, which restricts records from public access but allows criminal courts, prosecutors, and law enforcement agencies continued access to the records. This was enabled by the ‘Indiana Second Chance Law,’ which was legislated on July 1, 2013.

Expunging a Vigo County arrest record will prevent employers and other individuals from accessing your record. That said, not everyone is eligible for expungement.

Individuals who are convicted of misdemeanors, including Class D felonies or Level 6 felonies reduced to misdemeanors, may petition the courts to expunge their arrest records after five years following the date of conviction. However, the court will only restrict the relevant records if:

  • The required period has elapsed
  • There are no pending charges against the individual
  • There is no existing or pending driver’s license suspension
  • The individual has completed their sentence
  • The individual has not been convicted of a crime within the required period

For individuals with non-violent felonies, the required waiting period is eight years after the completion of their sentence.

Once this period has elapsed, the court will restrict the arrest record if:

  • The required period has elapsed
  • The individual has no pending charges
  • The individual does not have an existing or pending driver’s license suspension
  • The individual has completed their sentence
  • The individual has not been convicted of a crime within the required period

For individuals convicted of a violent or sexual felony, the waiting period is ten years after their sentence has been completed.

The court will order their arrest records to be restricted if:

  • The required period has elapsed
  • The individual has no pending charges
  • The individual does not have an existing or pending driver’s license suspension
  • The individual has completed their sentence
  • The individual has not been convicted of a crime within the required period

Vigo County Arrest Warrants

An arrest warrant is a legal document issued by a judge that authorizes a law enforcement officer to make an arrest. A warrant is issued when reasonable evidence is presented to a judge that convinces them that there is probable cause for an arrest. A warrant may also be issued if a person fails to follow a court order, such as a probation violation or the failure to appear at a hearing.

Warrants processed by the Vigo County Sheriff’s office are issued by the district court, and each warrant is signed and approved by a judge. Arrest warrants are issued when a suspect cannot be located or resides outside the state. They are also commonly issued for severe crimes that are violent or sexual in nature.

The information contained in an arrest warrant includes:

  • The name of the defendant (or their description)
  • The location of the defendant, if known
  • The offense the defendant is charged with
  • A command that the defendant be arrested and brought before the issuing judge

To find an active arrest warrant, you should contact the Vigo County Sheriff’s Office. The Vigo County Sheriff’s Department allows the public to look up active search warrants relevant to the county. This means you have a right to check if you or someone you know has an outstanding warrant in the county.

If you suspect that you have an active warrant, you can use the Vigo County jail arrest warrant search function. This enables you to look up arrest warrants within Vigo County by using criteria such as name, charges, etc.

Do Vigo County Arrest Warrants Expire?

In Indiana, arrest warrants for misdemeanors expire after 180 days. Warrants for felonies or rearrests, however, remain active indefinitely. This means the police possess the legal authority to arrest the suspect named in the warrant at any point in time, regardless of how much time has passed since the warrant was first issued.

If you have an active warrant, you have the option of filing a motion with the Court to have your warrant recalled. If this is successful, the warrant disappears. Factors such as the length of time that your warrant has been active, the charges laid against you, the state of your criminal record, etc., play a huge part in determining if the motion will be accepted. However, you should consult a lawyer to help you determine whether your case is eligible.
